Zmiany w e-commerce

Zmiany (Pakiet VAT e-Commerce 2021) pojawią się głównie w ustawie o podatku od towarów i usług. Najważniejsze z nich:

  • w transgranicznym handlu elektronicznym pomiędzy przedsiębiorcami i konsumentami (B2C) ma zostać wprowadzony mechanizm pojedynczego punktu kontaktowego na internetową sprzedaż towarów wewnątrz UE i z państw trzecich na rzecz nabywców/odbiorców końcowych (konsumentów)
  • podatnicy mają mieć możliwość rozliczania dla celów VAT transakcji dokonywanych na rzecz konsumentów w wielu krajach UE za pośrednictwem deklaracji VAT składanej tylko w jednym państwie członkowskim (tzw. państwie członkowskim identyfikacji),
  • zdefiniowanie pojęcia wewnątrzwspólnotowej sprzedaży towarów na odległość oraz wprowadzenia odpowiednich zmian (także o charakterze uchylającym obecne regulacje) do dotychczasowych przepisów dotyczących tzw. sprzedaży wysyłkowej,
  • rozszerzenie i modyfikacja procedury szczególnej dla usług telekomunikacyjnych, usług nadawczych lub usług świadczonych drogą elektroniczną (MOSS) na inne usługi świadczone na rzecz konsumentów, wewnątrzwspólnotową sprzedaż towarów na odległość oraz na dostawy towarów w państwie członkowskim dokonywane przez interfejsy elektroniczne ułatwiające te dostawy,
  • likwidacji zwolnienia z podatku VAT od importu towarów w przesyłkach o niskiej wartości do 22 EUR,
  • zdefiniowanie pojęcia sprzedaży na odległość towarów importowanych, zwanej „SOTI”,
  • wprowadzenie nowej procedury importu (IOSS) dla SOTI z krajów trzecich do konsumentów w UE, w przesyłkach o wartości rzeczywistej do 150 EUR,
  • wprowadzenie kolejnej (w przypadkach, gdy nie stosuje się IOSS), uproszczonej procedury w zakresie deklarowania i odroczenia płatności podatku z tytułu importu towarów, w przesyłkach o wartości nieprzekraczającej 150 euro, która będzie dostępna dla osób przedstawiających towary organom celnym (np. kurierów, pocztę) w imieniu własnym i na rzecz osoby, dla której towary są przeznaczone w państwie, w którym ma miejsce import.
