Kredyty hipoteczne spłaca ponad 4 miliony polaków. W ostatnich latach małżeństwa, w których dwie osoby pracowały, nie miały problemu z zaciągnięciem kredytu na własne cztery kąty. Niestety coraz więcej osób decyduje się na zakończenie związku małżeńskiego i rozwód. W takiej sytuacji pojawia się problem jak podzielić zarówno mieszkanie jak i kredyt. W niniejszym artykule przedstawimy rozwiązania jakie można wykorzystać oraz wskażemy na niebezpieczeństwa czyhające na byłych małżonków w przypadku niedopilnowania formalności związanych z kredytem.
Co można zrobić z kredytem po rozwodzie?
- Przepisać kredyt na jednego z byłych małżonków,

Dobrym rozwiązaniem często okazuje się przejęcie długu byłego małżonka przez innego członka rodziny osoby, która ma zatrzymać mieszkanie i dalej spłacać kredyt. Można również starać się uzyskać poręczenie innej osoby lub ustanowić hipotekę na kolejnej nieruchomości.
UWAGA!!! W przypadku przepisania kredytu na jednego z małżonków należy pamiętać o zmianie wpisów własności i hipoteki w księdze wieczystej.

Jeśli kredyt hipoteczny został zaciągnięty przed ślubem to osoba, która go zaciągnęła jest zobowiązana do dalszej spłaty. Jeśli małżonkowie nie rozszerzyli wspólności majątkowej na nieruchomość zakupioną przed ślubem to zatrzyma ona także własność mieszkania. Były partner będzie mógł natomiast domagać się od kredytobiorcy zwrotu odpowiedniej części nakładów na nieruchomość, poczynionych z majątku wspólnego.
